This Privacy Policy (the “Policy”) discloses the data practices of VehiclePrivacyReports.com (the “Site”), which is operated by Privacy4Cars, Inc. (“P4C”) and provides vehicle privacy reports (the “Service”).  To view the privacy policy of P4C, which applies to P4C’s website (located at Privacy4Cars.com), its mobile application and its other related products and services, please visit Privacy4Cars.com/privacy-policy-2/.

This Policy covers how Personal Data that we receive or collect about you from your use of the Site is used or shared.  By using our Services, you agree to these Policy terms as they may be amended from time to time.  We treat any data that identifies you, or reasonably can be linked to you or a vehicle that you own or lease, as “Personal Data.”  Data that has been de-identified so that it cannot reasonably be linked to you or your vehicle is not Personal Data, and we may use that data for any purpose.  When we maintain and use de-identified data, we do not attempt to re-identify the data unless you have given us consent to maintain and use the data in identifiable form.

Personal Data We Collect From You

Our Site collects Personal Data:

  • That you provide to us, such as contact information or your information about your vehicle (e.g. VIN or Vehicle Identification Number), when you seek to run a vehicle privacy report.
  • That is collected automatically from your visiting our website, such as your IP address, internet provider, operating system, browser used, and type of device.

How We Obtain Your Personal Data

We obtain Personal Data from you when you interact our Site, such as by filling out forms on our Site.

Our Use of Personal Data

We use your Personal Data to:

  • Provide Our Service, including to improve the quality, safety and security of the Service.
  • Communicate with You, such as using contact information that you provide to us to respond to communications, contact you about your transactions, promote our Services, provide other relevant information, and request information or feedback.
  • Conduct Internal Research, including developing, improving or repairing our Services.
  • Promote Security and Prevent Fraud, such as detecting, protecting against, or responding to security incidents, and preserving the integrity or security of our Service.
  • Comply with Laws, including complying with a lawful governmental request, protecting our rights, protecting your safety or the safety of others, or establishing or preserving a legal claim or defense.

We strive to retain your Personal Data only for as long as necessary to fulfill the purpose(s) for which we obtained the information or as otherwise required by law.  We presently retain Personal Data provided by customers for three years after the customer relationship has ended.

Our Sharing of Personal Data

We share Personal Data with service providers that perform certain tasks on our behalf in connection with our Site and Service.  Specifically, we share Personal Data with a limited number of service providers:

  • ClickMore Media, which processes and stores Personal Data to allow us to provide technology to operate our Services.

We require service providers to take reasonable steps to ensure that they keep Personal Data confidential and encourage them to only utilize Personal Data as permitted.

We also may share Personal Data:

  • with your consent, such to tender a consumer rights request on your behalf;
  • to respond to subpoenas, court orders, or other legal process or otherwise as required or allowed by law or the competent governmental or judicial authorities;
  • to cooperate with law enforcement, government or regulatory entities, and safety or investigation authorities;
  • to establish or preserve a legal claim or defense; or
  • as part of a corporate restructuring, sale of assets, merger or divestiture.

Finally, we may share VINs with unaffiliated third parties, such as dealerships, auction companies, manufacturers, financing companies and rental car companies to perform our Service and promote whether our Service has deleted data from a vehicle.  In some cases, we may publicly disclose whether data has been deleted from a vehicle corresponding to VIN, such as in our vehicle privacy reports.

We do not otherwise sell or share Personal Information to non-affiliated third parties without your consent.  We also have no actual knowledge of selling or sharing the Personal Information of minors under 16 years of age to non-affiliated third parties without affirmative consent.  The Site does not use or disclose sensitive personal information, as defined by the California Consumer Privacy Act.

Security of Your Personal Data

We use commercially reasonably physical, technical and administrative security measures to reduce the risk of loss, misuse, unauthorized access, and disclosure.  Please note, however, that no security measures are perfectly secure, and we are unable to guarantee the security of your Personal Data.

Third Party Websites and Applications

Our Site may contain links to websites or applications hosted by third parties.  In addition, we utilize social media channels.  This Policy only applies to our Service and does not apply to any third party sources.  Any data collected through third party websites or applications shall be subject to the privacy practices of the third party, and you should review the privacy policies of these third parties prior to sharing any data.

EU and UK Data Subjects

The EU’s General Data Protection Regulation and the UK Data Protection Act and UK General Data Protection Regulation provide EU and UK data subjects with the additional rights described below.

Use of Personal Data

We generally act as a data controller of EU and UK data subject’s Personal Data submitted to us. We rely on that Personal Data for the legitimate commercial purposes of providing our Services. Where we need to collect Personal Data by law or under the terms of a contract we have with you, and you fail to provide that Personal Data when requested, we may not be able to provide you with our Services. We consider and balance any potential impact on you and your rights before we process your Personal Data. We do not use your Personal Data for activities where our interests are overridden by the impact on you unless we have your consent or are otherwise required or permitted to by law.  In certain circumstances, we act as a data processor, and, in those circumstances, we process your Personal Data for the purposes set out in this Policy consistent with the data processing terms of those partners.  If we are relying on your consent to process your Personal Data, you have the right to withdraw your consent at any time by contacting us at the information below.  We will only use your Personal Data for the purposes for which we collected it unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. 

If you are located in the EU or UK and have any complaints regarding our privacy practices as a data controller, you have the right to make a complaint at any time to your local Supervisory Authority. However, we would appreciate the chance to address your concerns before you approach your Supervisory Authority, so please contact us first at the information below.

Data Subject Requests

If you would like to request a copy of your Personal Data being held by us, or request that data be deleted, corrected or transferred to another data controller, please follow the process detailed in the “Your Rights and Choices” section below.  Please note that there are certain exemptions and restrictions of these rights under the European data privacy laws that enable personal data to be retained, processed or withheld from access, and we will inform you of these exemptions and restrictions, if applicable.

International Data Transfers

We offer EU and UK Model Clauses, also known as Standard Contractual Clauses, to meet the adequacy and security requirements for our customers that operate in the European Union and the United Kingdom, and make transfers of Personal Data from those jurisdictions to the United States and other countries that lack adequacy determinations.  Please contact us as detailed in the “Contact Us” section below for more information.

Your Rights and Choices Regarding Your Data

We give you certain choices regarding our use and disclosure of your Personal Data for promotional purposes.  You can opt-out of all email correspondence by using the unsubscribe link located in all such communications or contacting us as described below.

We provide consumers with the following rights, including: (a) the right to know what personal data we have collected, used, disclosed and sold about you; (b) the right to request that we delete any personal data we have collected about you, subject to certain exceptions, and (c) the right to request that we correct inaccurate Personal Data that we maintain about you.  If you would like to exercise the above rights, please contact us by email at PrivacyReports@Privacy4Cars.com.  Regardless of whether we have a legal obligation, we will attempt to honor your request.

When you submit a request to us, we will verify your identity.  We may ask for your email address or other information that will allow us to verify that the request is coming from the person named in the request.  If we are unable to verify your identity, your request will be denied. You also may designate an authorized agent to make a request for deletion on your behalf, subject to appropriate verification.  Your exercise of these rights will have no adverse effect on the price and quality of our Services.

Personal Data Concerning Children

Our Site is not intended for anyone under the age of 16.  We do not knowingly collect Personal Data from individuals under the age of 16, unless the Personal Data is submitted with verifiable parental consent.

Updates to the Policy

We may update this Policy periodically as we offer new products and services, and as our business, technology, and laws change. You can determine when this Policy was last revised by referring to the “Last updated” reference below.  Any changes will become effective upon posting of the revised Policy or upon additional notice as legally required.
